Expiration in scenarios of State responsibility for conduct against humanity

The objective of this reflection article is to establish the possible wrongdoing in the sub-rule of the term of expiry of the responsibility of the State arising from conduct against humanity, established by the Council of State, in circumstances and events that occurred during the internal armed conflict in Colombia. A methodology of documentary analysis was adopted through a literature review. Data, arguments, and evidence were extracted using qualitative analysis techniques to organize and synthesize the collected information. The results obtained indicate the incongruity between the conception of the Council of State as a treaty judge, the application of the control of conventionality by that corporation and the non-observance of the precedent set by the Inter-American Court of Human Rights (IACHR) in the case of Órdenes Guerra, regarding the imprescriptibility of actions that allow compensation for anti-legal damages generated by this type of conduct.
